Article 1 – Definitions

In these General Terms and Conditions, the following definitions apply:

  • Cancellation period: The period during which the consumer can exercise their right of cancellation.
  • Consumer: A natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur.
  • Day: A calendar day.
  • Fixed-term transaction: A distance contract for a series of products and/or services that are delivered or purchased over a period of time.
  • Durable data carrier: Any medium that enables the consumer or entrepreneur to store information addressed to them in a way that allows future reference and unchanged reproduction.
  • Right of withdrawal: The consumer’s right to cancel the distance contract within the cancellation period.
  • Entrepreneur: The natural or legal person offering goods and/or services to consumers via distance selling.
  • Distance contract: An agreement concluded exclusively through one or more means of distance communication within the framework of a system organized by the entrepreneur for selling products or services remotely.
  • Distance communication technique: Any method that enables a contract to be concluded without the physical presence of both the consumer and the entrepreneur.
  • General terms and conditions: The current general terms and conditions of the entrepreneur.

Article 2 – Identity of the Entrepreneur

Article 3 – Applicability

  • These general terms and conditions apply to all offers, orders, and contracts between the entrepreneur and the consumer.
  • Before a distance contract is concluded, the consumer will have access to these terms and conditions. If that is not reasonably possible, the consumer will be informed on how to obtain them, and they will be sent free of charge upon request.
  • If a contract is concluded electronically, these terms may also be provided electronically so that the consumer can easily save them.
  • In the event of a conflict between these general terms and any specific product or service conditions, the consumer may rely on the most favorable provision.
  • If any provision in these terms becomes invalid or void, the remaining provisions shall remain in effect.
  • Situations not covered by these terms will be assessed in accordance with the overall intent of these conditions.

Article 4 – The Offer

  • If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
  • The entrepreneur reserves the right to modify the offer.
  • Product descriptions and images are as accurate as possible but may not perfectly match actual colors or details.
  • Prices exclude customs duties and import VAT, which are the consumer’s responsibility.

Article 5 – The Contract

  • A contract is formed when the consumer accepts the offer and meets the stated conditions.
  • If the consumer accepts an offer electronically, the entrepreneur will confirm receipt as soon as possible. Until this confirmation is received, the consumer may withdraw from the contract.
  • The entrepreneur takes appropriate security measures for online transactions and payments.
  • The entrepreneur reserves the right to refuse or impose conditions on an order based on a consumer’s payment history or other relevant factors.

Article 6 – Right of Withdrawal

  • Consumers have 14 days from the date of receiving a product to return it without stating a reason.
  • During this period, the consumer must handle the product with care. The product should be returned in its original condition and packaging.
  • The consumer must notify the entrepreneur in writing or via email within 14 days of receiving the product if they wish to withdraw. The return must be sent back within another 14 days after notification.
  • If the product is not returned within this timeframe, the purchase is considered final.

Article 7 – Costs of Withdrawal

  • The consumer is responsible for return shipping costs.
  • The entrepreneur will refund the purchase amount within 14 days of receiving the returned product or proof of shipment.

Article 8 – Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made or personalized products.
  • Products that cannot be returned due to hygiene reasons if the seal is broken.
  • Items that deteriorate quickly.
  • Digital content such as software once opened.

Article 9 – Restocking Fee

  • A 15% restocking fee may be applied to returns and deducted from the refund.
  • Consumers are advised to contact the company before returning an item.
  • Returns may be delayed or refused if the product is damaged, used, or not in its original packaging.

Article 10 – Pricing

  • Prices remain stable during the validity period of an offer, except in cases of VAT changes or other legal regulations.
  • Prices may fluctuate due to market conditions beyond the entrepreneur’s control.
  • Any price errors in offers do not oblige the entrepreneur to sell at the incorrect price.

Article 11 – Product Conformity and Warranty

  • Products will conform to the contract and relevant legal requirements at the time of purchase.
  • Any defects or incorrect deliveries must be reported in writing within 14 days of receipt.
  • The entrepreneur’s warranty does not cover damages resulting from improper use, self-repairs, or modifications.

Article 12 – Delivery & Execution

  • Orders will be processed with care and delivered to the address provided by the consumer.
  • Orders will be shipped within 30 days, unless a longer timeframe is agreed upon. If delivery is delayed, the consumer may cancel the order.
  • In case of cancellation due to delayed shipping, the entrepreneur will refund the consumer within 14 days.
  • If a product is unavailable, the entrepreneur may offer a replacement product. The consumer retains the right to withdraw from such a purchase.

Article 13 – Duration & Termination of Contracts

  • Consumers may cancel open-ended contracts for regular product deliveries with a maximum one-month notice period.
  • Fixed-term contracts cannot be automatically extended beyond the initial period without consumer consent.

Article 14 – Payments

  • Payments must be made within 7 working days of the contract being established, unless otherwise agreed.
  • Consumers must immediately report any errors in payment details.
  • Non-payment may result in additional charges and legal action if necessary.

Article 15 – Complaints & Dispute Resolution

  • Complaints should be submitted in writing within 7 days of the issue arising.
  • The entrepreneur will respond within 14 days and provide an estimated resolution timeframe if needed.
  • If a complaint cannot be resolved amicably, it will be handled according to the dispute resolution process.
  • A complaint does not suspend the consumer’s payment obligations.

Article 16 – Governing Law

  • All contracts and disputes between the consumer and entrepreneur are governed by Canadian law, even if the consumer resides abroad.
